38 and sometimes Althing made laws irrespective of any interference by the king. As the king’s power increased so the power of Althing diminished, but otherwise the law remained about the same as that made by the book ‘Ironsides’ and the old method of dividing the land into districts was the origin of the police magistrate constituencies (or districts) of the present day. Bailiffs were appointed as rulers^ police magistrates and revenue officers and the governor was chief of the revenue officers. The Clergy Power. In 1269 Bishop Thorlak, who was ordained as Bishop of Skal- holt, was an energetic man, and he asked the archbishop to give him authority to rule the churches and handle all their properly, but the farmers thought lie was not treating them justly and was trying to deprive them of their constitutional rights, the bishop claiming the right of the clergy and church to the fundamental system of govern- ment, while the farmers and leaders held to the original statutes of their forefathers and the later constitutional amendments, they having always used the profit accured from the real estate attached to the churches for their own benefit. One notable case the bishop brought before Althing was relative to a large real estate called Oddi, which the owners had always t.on- trolled, the bishop claiming it for the church, while the owners dis- puted his claim. But after a long and arduous trial, which lasted for a longer period than it would otherwise have done, owing to the excellent manner in which it was handled by Rafn Oddson. The bishop’s arguments were not generally accepted by Althing, so the bischop placed his case before the archbishop, while the farmers preferred to make their plea direct to the king, and by agreement between them both, it was agreed in 1297, that Bishop Arni should have command of all the diocese which were actual church property. But all church sees or real estate which belonged wholly or in lar- ger part to the farmers should be their individual property, but that they should pay the same amount of tax as they had before, to the bishopric.
